Pistol Stabilizers are BACK! | Federal Judge Blocks Nationwide Enforcement of the Pistol Brace Rule

Last Wednesday, Judge Matthew Kacsmaryk of the United States District Court in the Northern District of Texas granted injunction relief (an injunction) to prevent the ATF from enforcing the ATF’s Factoring Criteria for Firearms with Attached Stabilizing Braces rule-nationwide. What does this mean? In short, as far as pistol braces go, we’re back to 2021.

To obtain this injunction, the plaintiffs needed to satisfy four rules:

They must be likely to prevail on the merits.
They would suffer irreparable harm if denied.
The injury outweighs any harm that would be caused if the injunction is granted.
The public interest supports relief.

Judge Kacsmaryk also noted that the rule would cause horrendous strain on companies who produce stabilizing braces. “Additionally, ATF admits the 10-year cost of the Rule is over one billion dollars,” he wrote. “And because of the Rule, certain manufacturers that obtain most of their sales from stabilizing braces risk having to close their doors for good.” Here at Shockwave, we are very thankful for all the support our customers and 2^nd amendment organizations have provided to help keep the fight going. In the ruling Judge Kacsmaryk stated,“[T]he Court is certainly sympathetic to ATF’s concerns over public safety in the wake of tragic mass shootings. The Rule ’embodies salutary policy goals meant to protect vulnerable people in our society,’” Judge Kacsmaryk wrote in Britto v. ATF. “But public safety concerns must be addressed in ways that are lawful. This Rule is not.”

There are two main items he noted in his ruling for injunctive relief:

The ATF did not follow the Administrative Procedures Act (APA).

He wrote, ‘[t]he controlling law of this case is that the Government Defendants’ promulgation of the Final Rule ‘fails the logical-outgrowth test and violates the APA’ and ‘therefore must be set aside as unlawful’ under the APA,’”

The ATF is violating the 2^nd Amendment.

He added,“Absent injunctive relief, the Final Rule will impair and threaten to deprive them of their fundamental right to keep and bear commonly used arms as a means of achieving the inherently lawful ends of self-defense. See U.S. CONST. AMEND. II (providing that the ‘right of the people to keep and bear Arms, shall not be infringed.’).”

Here at Shockwave we worked tirelessly with U.S. Congressman Bilirakis, U.S. Congresswoman Anna Paulina Luna, and U.S. Senator Rick Scott to help overturn this rule through the power of the vote. While it won in the House, it did fail in the Senate. So, it was back to the courts to help stop this overreach. Throughout the recent months there have been many injunctions set in place for Gun Owners of America, Second Amendment Foundation, FPC, and more. However, in order to be protected you would have needed to be named plaintiff or a member of one of these originations. With this new nationwide injunction from Judge Kasmaryk, that is no longer the case. All Americans are protected.

We are very thankful for all the hard work these 2^nd amendment organizations do to help support companies like us and law abiding citizens who enjoy their 2^nd amendment rights. So where do we go from here? Most certainly the Justice Department will appeal this ruling to the 5^th Circuit Court of Appeals. The consensus among the legal community is that they will support the injunction relief and issue a permanent injunction in the coming months. As to the various lawsuits themselves? These will be a long endeavor and will likely take years to work through the legal system. Eventually, the U.S. Supreme Court will probably hear them. In the meantime, Americans will be protected by the injunctions.

Take Me Home, Country Roads…

After seven years of sun and fun—and a whole lot of hard work—it was time to head on back to where it all started: home. Back to Utah.

Sure, we’ll miss the oppressive heat and humidity, alligators crawling across the Publix parking lot, sinkholes swallowing up entire neighborhoods, the hurricanes, the tropical storms, the tornadoes, being eaten alive by mosquitoes and noseeums, and arguably America’s worst drivers. LOL

But seriously, we’ll miss being able to eat a Pub Sub, killer sunsets over the Gulf, spotting manatees in Crystal River, fishing Honeymoon Island, exploring the sandy beaches for shells, enjoying rich cultural experiences in most every city we visited, and wondering why there are so many chickens just walking around Key West.

Family obligations necessitated a return, so we moved Shockwave this August. And honestly, it feels so good to be home. Clean air, mountains all around, the changing seasons. We missed it all.

As they say, it’s good to be home.

When it comes to indoor shooting range etiquette, some things are black-and-white — while others are a bit gray. Here’s one example:

Should you shoot your short-barreled AR-15 at an indoor range?

Short answer:

As the decibel is logarithmic, this is a very noticeable difference.

However, because the overall sound level isn’t affected — just redirected — the Flash Forward isn’t considered an NFA item. It’s classified as a simple “threaded muzzle device.”

Please note that OSHA’s “hearing safe” threshold is 140 dB. The Flash Forward is not an approved hearing-safe suppressor. Please always wear hearing protection, such as OSHA-approved ear plugs, earbuds, or over-the-ear earmuffs.

What About Permanent Installation?

Another option is to extend your pistol barrel to rifle length with a permanent installation. You can do this ATF-approved modification and easily convert your pistol to a rifle.

In most cases, it’s a better solution than buying a new longer barrel to convert it, as you also get the sound-mitigation benefits.

For the Flash Forward™ MK 1 MOD 1, we will offer an easy-to-use silver soldering kit. The silver solder we will offer has a melting point of 1,145 degrees. (ATF’s requirement is 1,100 degrees or more.) Contrary to what you may have heard, permanently attaching a muzzle device with silver solder really isn’t any more difficult than sweating copper tubing when doing plumbing. Given an overall length of 9.00” and assuming a threading interface of 0.625”, the Flash Forward lengthens your barrel by 8.375”. The 1.50” outer diameter fits under many popular handguards.

Some recommend using a 55-grain soft-point load that minimizes bullet penetration, which can be beneficial to protect your family in other parts of the home (or surrounding neighbors) in case the bullet misses the intended target. However, as you may know, the AR-15 is available in a multitude of calibers.

Size

During a home invasion, you don’t want to be turning corners and allow the intruder to discover your location before you know theirs. The AR-15 pistol is a great option for home defense due to its relatively short length, allowing you to turn corners discreetly and avoid disclosing your location that can put your defense game at risk.

Customizable

Why are ergonomics important in firearm design?

If you’ve never thought about what ergonomics are or why they’re important, I’m about to change your perspective on gun purchasing forever.

While most people think of ergonomics in the workplace, they also matter to products we love to use — like firearms. In the firearms world, a product that’s ergonomic means it’s been designed to fit the user in a safer, more comfortable, and more practical way.

Why is that important? Because, believe it or not, ergonomics affect your entire body. When shooting a gun, you hold your body and arms in a specific position to have proper sight/picture alignment, firearm control, and recoil management. However slight, poor ergonomics of a firearm can have a significant impact on your musculoskeletal system, which controls your muscles, joints, tendons, ligaments, and nerves. Buyer Beware: Are You Buying a Real Shockwave Product or a Fake?

Here’s the unfortunate truth: online scams, counterfeits, and con artists have been on a rising rampage — especially during COVID-19.

And this applies to firearm sales, too.

At Shockwave Technologies, we want to ensure our customers are protected from buying into these scams and frauds. We’re proud to have all Shockwave products (truly) made in America and strive to support local businesses every chance we can. But unauthorized fake products coming in from other countries threaten our economy and swindle gun buyers into purchasing low-quality (or illegally made) products without them realizing it.

Let’s take a look at a few steps gun buyers (like yourself) can take to prevent being swindled and combat this “dark side” of purchasing guns and gun parts, both online and in the store. And specifically, how to ensure you’re getting a genuine Shockwave product.

Do your due diligence.

If you’re buying a true Shockwave product, you’re paying for a top-quality product that is built on ethical standards. Don’t let scammers take advantage of you by taking your hard-earned money and giving you a fake item. And not just fake — a poorly built or illegally-made item, too. So it’s essential to do your due diligence and ensure a product has all the right components of a true Shockwave product.

Let’s take a look at what makes a product fake, why it’s important, and a checklist of things you need to look for.

What makes a product fake?

Fake products are anything that’s claimed to be something that it’s not, from designer bags to collector items and everything in between. Some gun dealers falsely claim the Chinese-made products they are selling are Shockwave products, made in America, and ATF approved. Genuine Shockwave products are truly made in America and ATF approved.

Why does it matter?

Think about it — if you pay $100 for a fake product that is normally $200 for the real product (for example), you didn’t save money at all. You just wasted $100 on something that is low quality, likely illegally made, potentially dangerous for you and/or your firearm to use, and won’t give you the product experience you think you’re getting with the real product. Giving even one dollar to a false manufacturer or dealer is supporting their scam and keeping them in business to continue growing and scamming gun buyers with their fake products.

These unethical dealers not only rob ethical, American-made companies from providing the real deal to everyday guy buyers, but they rob their own customers by tricking them to spend their hard-earned money on a counterfeit product. If you’re going to pay hundreds, if not thousands, of dollars for a gun and gun parts, you deserve to get the real deal.

Diligently examine the products you plan to purchase with the intent of finding a red flag. If you don’t find an immediate red flag, follow the checklist below. It’s better to be a skeptic going into purchasing expensive, dangerous products than it is to assume it’s legitimate.

How to make sure you’re getting a genuine firearm product:

Does the price sound too good to be true? Then it probably is. The price of the gun or gun part should be reasonable and comparable. Huge discounts on high-end products, items that are highly underpriced from the average cost, or advertisements that push a major sense of urgency with a great deal (i.e. “one time only”) tend to be scams and counterfeits.
Is the dealer reputable and established? Check out their return policies, secure payment options, and make sure you’ll get a descriptive receipt. You can look at their FAQs, policies, and terms of purchase to understand what’s guaranteed. Here’s an example of this information that Shockwave provides. Be skeptical if you read passive words like “probably,” “in the style of,” or “type.”
Is there a serial number on the gun? Or a patent number on the Shockwave gun part? There should be. If there isn’t one, be skeptical. But how do you know if it’s a bogus number? You can check out Google’s Advanced Patent Search to determine if a patent number is real, and HotGunz to look up a gun’s serial number to determine if it has been stolen or a fake.
Are there multiple photos of the gun? The best sellers and dealers will post multiple photos, including close-ups. Make sure the photos don’t look Photoshopped or altered.
Is there a detailed description? A complete description that shows all details of the product for sale is important for making sure all information is accurate.
Is there a secure payment method accepted? Do not use PayPal or a PayPal-affiliated platform, as they have banned firearm sales and will seize your transaction funds if you try to use it. Money orders and checks are a scammer’s preferred way to get paid because it’s untraceable and makes it easy to steal information for identity theft. The best bet is to pay securely via credit card.

Channel your inner detective.

Following the provided checklist is an important method to ensure you purchase a genuine product. But let’s walk through a couple actual fake copycats of Shockwave products and show you how to play detective.

This is a Chinese product that sold lookalike counterfeit items labeled as “Blade” — but don’t worry, we got them shut down. The item claimed to be a Shockwave Blade, but it was a fake.

These items are still being sold and marketed as a Raptor grip, but don’t be fooled — this is no raptor grip. It is yet to be determined who is making these but they falsely claim to be a Raptor grip.

They also claim these products are made in America, but that is yet to be determined. These items are counterfeit because they have no plug for the bolt hole and are not made by Shockwave Technologies or used by the Mossberg or Remington firearms.

When it comes to our Blades, it is especially important that consumers have a brace that is ATF approved for pistol use. We have found some very interesting ones on the market that are alarmingly fake (and ugly, if we might add).

New Shockwave Blades are labeled with our patent number. Grips have the Shockwave Technologies name on it and a plug in the back.
